Thank you for your interest in FormEagle, a service provided by Clicksambo OÜ ("FormEagle", "we" or "us"). By registering an account or accessing any FormEagle services ("Services") available via FormEagle websites and/or mobile application ("App"), you agree to all the terms and conditions ("Terms"), together with any amendments, of this Terms of Service Agreement ("Agreement"). If you are using the Service on behalf of a company or other entity ("Company"), then you are agreeing to all these Terms on behalf of that Company, and you represent and warrant that you have the authority to bind the Company to this Agreement. In that case, "you" and "your" refers to you and that Company.
Services Overview
FormEagle is an all-in-one platform designed to automate your lead capture and management, freeing you from manual lead downloads. FormEagle seamlessly integrate with Meta Ads, TikTok Ads, web forms to centralize your leads in one place. Our services include automated lead capture, centralized lead management, real-time notifications, a self-service Meta Forms API, and reporting & analytics. FormEagle simplifies the use of the Meta API, allowing you to focus on your business. By granting us permission to access your Meta Ads account, we automatically capture leads as they come in, ensuring you never miss an opportunity.
Account Registration and Management
To register an account, you must provide accurate and complete information, including your username, email address, and phone number. By creating an account, you agree to grant FormEagle permission to access and manage your lead data from connected third-party platforms (e.g., Meta Ads) as necessary to provide the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You can start to use a forever free plan and upgrade to other plans which may require credit card details. If you do not wish to continue using FormEagle you can cancel your subscription. Forever Free plan lets you get started with FormEagle at no cost. This plan includes up to 10 form views per day. Once the daily limit is reached, your forms remain visible, but detailed responses submitted after the limit will be partially obscured or unavailable until the limit resets at 00:00 UTC. You will receive a notification within the FormEagle platform when you are approaching your daily limit.
Subscription and Pricing
FormEagle offers a Forever Free plan, allowing you to get started with limited features and up to 10 form views per day. To access more features and higher usage limits, you can upgrade to one of our paid subscription plans at any time.
When you pay by credit card, you authorise us to charge your credit card or bank account for all fees payable during the Subscription Term. You further authorise us to use a third party to process payments, and consent to the disclosure of your payment information to such third party.
Your subscription will be automatically renewed at the amount and frequency as specified in your selected Subscription Plan (e.g. monthly, yearly, or another period), until cancelled. You may cancel your FormEagle subscription at any time without penalty, after which you will no longer be billed. If you cancel your subscription, you may continue to use your subscription until the end of your then-current Subscription Term.
Data and Privacy
To register an account, you must submit contact information such as your user name, email address, and phone number. This information is used to verify, secure, and provide access to your account. We use cookies on the site to keep you logged in. FormEagle may also store basic technical information, such as your IP address, in memory or logs.
Through FormEagle Services, you will have the option to import and integrate leads to your platforms. This leads data, along with the aforementioned data and contact information submitted by or for you to the FormEagle Services, including electronic data and information submitted by or for you through your use of third-party applications, or collected and processed automatically by or for you using the FormEagle Services is herein referred to as "Your Data".
Your Data may be used to deliver, maintain, and improve our services, including for troubleshooting, data analytics, testing, research, statistical, and survey purposes. We may also use Your Data to contact and provide you with Services that you request, develop new Services, suggest personally relevant features, and to keep our services, business, and users safe and secure.
Data Security
We implement a variety of security measures to help keep Your Data secure. Your Data is fully encrypted in transit (TLS 1.2 via HTTPS) and in the database (256-bit Advanced Encryption Standard). We're committed to using the highest grade technology to secure and protect Your Data.
Account Security
FormEagle offers a secure login process using email based one-time passwords ("OTP"). You are solely responsible for controlling who has access to your account by limiting access to your computers and devices, and with whom you share your OTP code(s) with for multiple device logins.
Third-Party Services
The Services include features and/or functionality that interoperate with online services operated by third-parties ("Third-Party Services"), pursuant to agreements between FormEagle and the operators of such Third-Party Services (such agreements, "Third-Party Agreements" and such operators, "Operators") or through application programming interfaces or other means of interoperability made generally available by the Operators ("Third-Party APIs") which FormEagle does not control. Third-Party Agreements and Third-Party APIs (and the policies, terms and rules applicable to Third-Party APIs) may be modified, suspended or terminated at any time. FormEagle shall have no liability with respect to any such modification, suspension or termination. You are responsible for ensuring that your use of the Services in connection with any Third-Party Service complies with all agreements, policies, terms and rules applicable to such Third-Party Service.
No Unlawful or Prohibited Uses
As a condition of your use of the Service, you will not use the Service for any purpose that is unlawful or prohibited by this Agreement. You may not use the Service in any manner that in our sole discretion could damage, disable, overburden, impair or interfere with any other party's use of it. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Service. In addition, you agree not to use false or misleading information in connection with your account, and acknowledge that we reserve the right to disable any account with a profile which we believe (in our sole discretion) is false or misleading (including a profile that impersonates a third party).
Modification and Termination of Services
FormEagle reserves the right to modify, update or discontinue our Services, or any features or portions thereof, without prior notice. You agree that we can suspend or terminate your right to access our Services at any time without notice, obligation or liability to you should you be found in violation of the Terms.
You may also terminate this Agreement at any time, for any reason or for no reason, by deleting your account through the Service and/or sending us an email at support@clicksambo.com to delete Your Data.
Data Usage and Lead Ownership
You retain full ownership of all lead data ("Lead Data") collected and managed through FormEagle. By using FormEagle, you grant us the right to access, process, and store your Lead Data for the purpose of providing you with the Services. You are responsible for ensuring that your collection and use of Lead Data complies with all applicable laws and regulations, including but not limited to privacy laws and data protection regulations.
You acknowledge that FormEagle is not responsible for the accuracy, legality, or appropriateness of any Lead Data you collect through the Services.
Limitation of Liability
To the fullest extent allowed by applicable law, you agree to indemnify and hold FormEagle and its affiliates, employees and partners harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys' fees) resulting from or in any way related to any third party claims relating to (a) your use or misuse of the Services (including any actions taken by a third party using your account); (b) errors in the content or interruptions in the Services; (c) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Services; (d) any unauthorised access to or use of our servers and/or any and all personal information and/or financial information stored therein. In the event of such a claim, suit, or action ("Claim"), we will attempt to provide notice of the Claim to the contact information we have for your account (provided that failure to deliver such notice shall not eliminate or reduce your indemnification obligations hereunder).
Arbitration Agreement
Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in Tallinn in accordance with the Arbitration Rules of the Estonian Chamber of Commerce and Industry for the time being in force, which rules are deemed to be incorporated by reference in this clause.
The Tribunal shall consist of one arbitrator, and the language of the arbitration shall be in English.
Applicable Law and Jurisdiction
This Agreement shall be governed by the laws of Estonia without regard to its conflict of laws provisions.
Your Data may be processed, stored, and used outside of the country in which you are located. Data privacy laws vary across jurisdictions, and different laws may be applicable to Your Data depending on where it is processed, stored, or used.
General Provisions
Severability: If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be reformed to the extent necessary to make it valid and enforceable, and the remaining provisions of this Agreement shall continue in full force and effect. The invalid or unenforceable provision shall be deemed severable from this Agreement.
